This Content Policy establishes the standards for all content uploaded, shared, or distributed on BLACKNWHITESIX. It applies equally to all users, including artists, listeners, and collaborators. By using the Platform you agree to comply with this policy.
2. Permitted Content
2.1 Audio
Original music and audio recordings that you own or have the rights to distribute. Supported formats: MP3, WAV, FLAC, AAC, and OGG.
2.2 Artwork
Cover artwork and images associated with your tracks or profile. Supported formats: JPEG, PNG, and WebP.
2.3 Metadata
Titles, descriptions, genre tags, credits, and other textual information that accurately describes your content.
3. Prohibited Content
The following categories of content are strictly prohibited on BLACKNWHITESIX. Uploading prohibited content may result in immediate removal, account suspension, or termination.
3.1 Copyright Infringement
Content you do not own or have authorisation to distribute;
Unauthorised remixes, covers, or derivative works without the rights holder's permission;
Tracks containing uncleared samples, loops, or beats;
Audio ripped from other platforms, streams, or recordings.
3.2 Harmful Content
Content that promotes or glorifies violence;
Content that promotes or supports terrorism;
Content that constitutes harassment, bullying, or targeted abuse of individuals;
Content that promotes or encourages self-harm or suicide.
3.3 Illegal Content
Content that promotes or facilitates illegal activities;
Child sexual abuse material (CSAM) — any such content will be immediately removed and reported to law enforcement;
Content that violates South African law or the laws of the jurisdiction from which it is uploaded.
3.4 Deceptive Content
AI-generated content that is not disclosed as such at the time of upload;
Misleading metadata, including inaccurate titles, descriptions, credits, or genre tags designed to deceive listeners;
Artificial manipulation of play counts, downloads, or engagement metrics.
3.5 Malicious Content
Files containing malware, viruses, trojans, or any other malicious code;
Content designed to exploit vulnerabilities in the Platform or end-user devices.
4. Explicit Content
4.1 Labelling Requirement
All content containing explicit language, sexual themes, or graphic imagery must be labelled as explicit at the time of upload. Failure to accurately label explicit content is a violation of this policy.
4.2 Minor Protection
Content labelled as explicit is automatically hidden from users who are under 18 years of age. Minor users cannot override this restriction.
4.3 Explicit vs. Prohibited
Explicit content is content that is legal but may not be suitable for all audiences. Explicit labelling does not excuse content that falls into any of the prohibited categories listed in Section 3. Content that is both explicit and prohibited will be removed regardless of labelling.
5. Reporting Content
If you encounter content that you believe violates this policy, you may report it using one of the following methods:
Use the Report button available on every track page;
All reports are reviewed within 48 hours of submission. You will receive a confirmation when your report is received and a follow-up when a decision has been made.
6. Enforcement Actions
Enforcement is proportional to the severity and frequency of violations:

Content flagged for review; artist notified and given the opportunity to correct the issue.
Moderate
Content removed from the Platform; formal warning issued to the artist.
Severe
Content removed; artist account suspended pending review.
Critical
Content removed immediately; artist account terminated; incident reported to law enforcement where required.
7. Content Takedowns
7.1 Takedown Process
The artist is notified of the takedown and the reason;
The track is made inaccessible to all users;
The artist has a 14-day appeal window from the date of notification.
7.2 Purchaser Access After Takedown
Copyright takedowns: Purchasers lose access to the content, as the distribution was unauthorised.
Policy violation takedowns: Purchaser access is determined on a case-by-case basis depending on the nature of the violation.
7.3 Appeals
If you believe your content was removed in error, you may submit an appeal to legal@blacknwhitesix.com within 7 business days of the takedown notification. Include a detailed explanation and any supporting evidence.
8. Copyright (DMCA-Style Process)
8.1 Filing a Notice
If you believe your copyrighted work has been used on BLACKNWHITESIX without authorisation, submit a takedown notice that includes:
Identification of the copyrighted work you claim has been infringed;
Identification of the infringing content on the Platform, including the URL or track ID;
Your contact information (name, address, email, phone number);
A statement that you have a good faith belief that the use of the material is not authorised by the rights holder, its agent, or the law;
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on their behalf;
Your physical or electronic signature.
8.2 Counter-Notice
If your content was removed and you believe the takedown was issued in error, you may file a counter-notice that includes:
Identification of the content that was removed;
A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification;
Your contact information;
A statement consenting to the jurisdiction of the relevant courts;
Your physical or electronic signature.
Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, the content may be restored.
9. Automated Systems
BLACKNWHITESIX employs automated systems to assist in content moderation. These systems may:
Scan uploads for potential copyright infringement;
Detect artificial or manipulated play counts;
Flag content that may require explicit labelling.
All automated decisions are subject to human review. No account will be suspended or terminated based solely on an automated decision without human confirmation.
